The term “Biennale.io” encompasses not just the website but also all the services we provide, including our mobile apps (if applicable), APIs, embeds, our online platform, and any other digital services offered by us. Abusive Conduct

A creator on Biennale.io is an artist who establishes a presence on our platform to connect with art enthusiasts and supporters. These supporters engage with artists through different types of reactions and engagement to artworks, to foster the creator’s artistic endeavors. There are several key points below concerning payments, fees, taxes, and limitations that are critical for a creator to understand fully. 

Creator Page 

Becoming a creator on Biennale.io is a straightforward process: your submitted art will go through an automated curation then a review process by the community council, once accepted it will show in the public space for visitors to interact with.  By joining Biennale.io, you integrate yourself into a vibrant community of artists and art lovers. We offer a suite of tools designed to help you showcase your work, engage with the broader Biennale.io community. 

Memberships on Biennale.io are gained through valuable creation and commitment, every member is someway adding value and helping the community to grow and thrive. This platform enables you to offer something unique and enthralling to your fans, providing them with special immersive community experiences they desire. In exchange, you gain their support, alongside revenue driven by the subscription revenue distributed to active community members, the allocation and distribution system is explained in the Revenue Policy. 

Content and Conduct Restrictions 

While we strive to maintain a platform that celebrates artistic freedom, there are boundaries to ensure a safe and respectful environment: 

Acceptable Use: We trust our creators to use Biennale.io responsibly. Content that is illegal, abusive, or violates the rights of others is not tolerated. Familiarize yourself with our Community Guidelines for a comprehensive overview of acceptable use. 

Intellectual Property: Your creations are your own. Biennale.io champions intellectual property rights, providing mechanisms for creators to report infringement and for disputes to be resolved fairly. 

At Biennale.io, we uphold a commitment to fostering a respectful and legally compliant community. Accordingly, there are clear boundaries on the types of creations and benefits offered through our platform.   • Illegal Creations or Benefits: Any content or reward that contravenes local or international laws is prohibited. 
  • Abusive Creations or Benefits: We do not tolerate content that harms, harasses, or is intended to abuse others. 
  • Misleading or Deceptive Creations or Benefits: Transparency is crucial. Creations or benefits that aim to deceive members of our community are not allowed. 
  • Unauthorized Use of Intellectual Property: It’s important to respect others’ rights. Do not use someone else’s intellectual property without express written consent or unless your usage qualifies as fair use. 
  • Adult Content Involving Real People: We prohibit the distribution of benefits or creations that involve real individuals in explicit sexual activities.

For Biennale.io Members 

A Biennale.io Member is someone who supports the platform by paying monthly fees for varying levels of membership. These memberships provide special access and benefits from the vibrant community of artists and creators on Biennale.io. By choosing a particular membership level, members receive benefits and can directly interact with creators, gaining exclusive access to content and becoming part of a diverse community that celebrates and supports art. 

As a Biennale.io Member, your contributions play a crucial role in sustaining the active community of artists and council members. In return, you might enjoy unique perks such as exclusive content, early access to new artworks, and special recognitions. Memberships are debited on a regularly recurring monthly basis, with Biennale.io overseeing the transaction process. Should your designated primary payment method fail, and backup methods are in place, we will proceed with the payment using those backups as outlined in your account settings. 

Before you commit to membership, we ensure you have clear information about the benefits associated with each level, as well as the timing and amount of your subscription commitments. You can effortlessly manage your memberships and review your billing history within your account dashboard. 

Becoming a Biennale.io Member is straightforward — select your preferred level of membership or explore additional offerings on Biennale.io tailored to your interests.  

Upon completion of all related charges, members are afforded a non-exclusive, revocable, and limited license to access content curated specifically for personal enjoyment. While most content remains accessible as long as the membership is active, certain exceptions, as outlined later, may apply. 

At Biennale.io, membership is simplified to a singular, primary model: a monthly subscription. This approach reinforces the bond between members and the creators they support. Specific benefits and the detailed arrangement for each membership tier will be transparently laid out before you finalize your subscription. 

Memberships auto-renew each month until you decide to cancel via the account settings. Flexibility in managing your membership means you can adjust or terminate your subscription at any point. Changes to your membership status could influence the access level and privileges previously enjoyed. 

Through these memberships, Biennale.io Members significantly aid in covering operational costs and in turn, foster a robust distribution of revenue among the platform’s artists and council members. While offerings may vary, our goal is always to present a value-packed selection that enhances the experience for all involved. 

In pursuit of the best art platform experience, we consistently introduce new features to Biennale.io, aimed at enriching interactions between members and creators. Access to developing features isn’t guaranteed but reflects our dedication to innovation and improvement. 

Refund Policy: Our standard policy refrains from offering refunds, including for lost access to specific offerings and membership benefits. Exceptions to this policy are at our sole discretion.  

Tax Information:  

Applicable taxes based on member location may be added to the subscription fee. These taxes are adjustable in response to any rate changes and are efficiently managed and remitted by Biennale.io in compliance with legal standards. 

Foreign Transaction Fees: For payments made in a foreign currency or processed outside the payment instrument’s country of origin, financial institutions may impose additional fees. Biennale.io does not apply these fees nor benefits from them. 

Our mission is to cultivate a thriving global art community. As a Biennale.io Member, you are integral to realizing this vision, supporting artists, and fostering the creation of extraordinary art. 

Account Deletion 

In brief: Your account can be deleted upon request, and we reserve the right to terminate or suspend it based on our judgment. 

At any moment, should you decide to part ways with Biennale.io, you can initiate the permanent deletion of your account by navigating to profile settings. 

Biennale.io holds the authority to terminate or suspend any member’s account according to our discernment. Furthermore, we have the discretion to cancel memberships, and remove any content, offerings, or benefits tied to your account without prior notice. 

Members are prohibited from lodging claims against Biennale.io for the suspension or termination of their own or another user’s account. Should you attempt to file such a claim, you will be held accountable for any resultant damages, including legal fees and other expenses. This agreement persists even if you decide to delete your account or if your account is no longer active. 

Indemnity 

If your actions on Biennale.io lead to legal action against us, you’re responsible for covering the costs. 

You agree to indemnify Biennale.io and hold us harmless from any losses, liabilities, and legal fees that result from your breach of these terms or your activities and conduct on Biennale.io. We hold the exclusive right to handle the defense for any claim that falls under this indemnity clause. In the event we choose to exercise this right, you are required to cooperate with us in our defense efforts. This indemnification duty extends to our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers. 

Warranty Disclaimer 

We strive to ensure Biennale.io operates smoothly, but certain things are beyond our control. 

Biennale.io is offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement. We explicitly disclaim any and all warranties, to the fullest extent permitted by law. This warranty disclaimer extends to our subsidiaries, affiliates, and third-party service providers involved in Biennale.io. 

Limitation of Liability 

Our financial liability to you is limited strictly to the amount you have contributed to Biennale.io. 

To the maximum extent permitted under applicable law, we shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from these terms, or your use or attempt to use Biennale.io. Our liability for damages is strictly limited to the amount of money we have received from your contributions to the platform in the current fiscal year only. Specifically, we are not liable for losses tied to unrealized benefits or conflicts arising from external agreements. The term “we” encompasses Biennale.io, along with our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers. 

Dispute Resolution 

For any issue, we highly encourage reaching out directly. Should disputes arise, they’ll be resolved under the jurisdiction and laws of England, United Kingdom. 

Should you have any concerns, we urge you to contact us first. In the event of a dispute related to these terms or your engagement with Biennale.io, such disputes will be settled in accordance with the laws and in the courts of our official domicile. Both parties agree to the exclusive resolution of disputes within this jurisdiction, governed by the laws applicable there, excluding any choice or conflict of law provision or rule. 

Everything Else 

This document, along with any referenced policies, represents our complete agreement and any significant changes will be communicated to you. 

These terms, together with referenced policies, form the complete agreement between you and Biennale.io, superseding prior arrangements. There is no intent to form any sort of partnership or employment relationship through these terms. Should any provision be deemed unenforceable, it will be adjusted to make it enforceable, or omitted, without affecting the remainder of the terms. Failure to enforce any part of these terms does not equate to a waiver of any rights. 

We reserve the right to modify these terms as necessary. Should there be material changes, we will inform you before they take effect. By continuing to use Biennale.io post-change, you agree to the amended terms.
