Biennale.io – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Biennale.io and Hub.Biennale.io (together, the “Platform”), operated by Biennale.io LTD (“Biennale.io”, “we”, “our”, “us”).
By using the Platform, you (“you”, “your”, “user”) agree to these Terms. If you do not agree, you must not use the Platform.
1. Scope of Services
1.1 Biennale.io: A subscription-based platform where art enthusiasts (“Subscribers”) access curated visual art. Works are selected exclusively by the Biennale.io Curation Council (the “Council”).
1.2 Hub.Biennale.io: A professional hub for artists to upload and share works with industry peers. Access is capacity-limited and free for artists. Content uploaded to the Hub is not automatically displayed on Biennale.io.
2. Eligibility
2.1 You must be at least 18 years old (or have guardian consent).
2.2 By using the Platform, you represent that you have legal capacity to enter into this agreement.
3. Artist Ownership and Rights
3.1 Artists retain full copyright and moral rights to their works.
3.2 Licence: Artists grant Biennale.io a limited, revocable licence to store and display works, subject to Council selection.
3.3 Revenue Sharing: Artists selected for Biennale.io display are compensated fairly.
3.4 Responsibility: Users warrant they own uploaded content.
3.5 Infringement: Proven infringements may lead to removal, suspension, or legal action.
4. Subscriptions and Payments
4.1 Subscribers pay recurring fees for Biennale.io access.
4.2 Payments handled securely by third-party providers.
4.3 Subscriptions renew automatically unless cancelled.
4.4 Refunds provided as legally required, or at Biennale.io’s discretion.
5. Prohibited Conduct
- Uploading works without rights
- Infringing IP or data protection laws
- Circumventing fees or disrupting services
- Uploading unlawful or harmful content
6. Content Moderation and Removal
6.1 Biennale.io: Only Council-approved works are displayed.
6.2 Hub.Biennale.io: Artists may upload freely; non-approved works remain in their Hub.
6.3 Infringement: Violations trigger removal and possible account suspension.
7. AI and Curation
7.1 AI tools support curation and discovery; no ownership is claimed.
7.2 Works not used for external AI training unless agreed.
7.3 Final decisions rest with the Council.
8. Intellectual Property
8.1 Except for artist-uploaded works, all other content (software, design, trademarks) belongs to Biennale.io or licensors.
8.2 No reproduction without written permission.
9. Liability and Disclaimers
9.1 Platform provided “as is”, no guarantees of uninterrupted access.
9.2 Biennale.io not liable for: user infringements, losses beyond subscription fees (12 months), third-party failures.
9.3 Exclusions do not apply where unlawful (fraud, injury).
10. Termination
10.1 Users may terminate accounts at any time.
10.2 Biennale.io may terminate accounts for violations or harmful behaviour.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Disputes fall under exclusive jurisdiction of its courts.
